1. PURPOSE AND ACCEPTANCE

These General Conditions regulate the acquisition of services offered on the website www.vinilartkids.com, owned by CARMONA PRIEGO SL (hereinafter, VINILART KIDS).

The acquisition of any of the services implies full and unconditional acceptance of all these General Conditions, without prejudice to the acceptance of any Specific Conditions that may apply when acquiring certain services.

These General Conditions may be modified without prior notice, so it is advisable to read their content carefully before proceeding with the acquisition of any of the offered services.

The products offered, together with their main characteristics and price, are displayed on the screen.

VINILARTKIDS reserves the right to decide, at any given time, the products and/or services offered to customers. Thus, VINILARTKIDS may, at any time, add new products and/or services to those currently offered. Likewise, VINILARTKIDS reserves the right to withdraw or stop offering any of the products without prior notice.

Acquisition of some products may require user subscription or registration, with VINILARTKIDS providing a Username and password to identify and enable access to the website. After logging into www.vinilartkids.com, and to access the purchase of various products, the user must follow all instructions indicated in the purchase process, which includes reading and accepting all general and specific conditions set out on www.vinilartkids.com.

4. AVAILABILITY AND SUBSTITUTIONS

VINILARTKIDS aims to guarantee the availability of all products advertised on www.vinilartkids.com. However, if any requested product is not available or has run out, the customer will be informed by phone as soon as possible.

If the product is not available and the consumer has been informed, VINILARTKIDS may supply a product of similar characteristics at no additional cost, in which case, the consumer may accept or reject it, exercising their right of withdrawal and contract resolution.

In case of unavailability of all or part of the order, and rejection of the replacement products by the customer, the previously paid amount will be refunded using the same payment method. If VINILARTKIDS unjustifiably delays the return of the amounts paid, the consumer may claim double the amount.

5. PURCHASE AND/OR CONTRACTING PROCESS

To make any purchase on www.vinilartkids.com, the customer must be of legal age.

Additionally, the customer must register on www.vinilartkids.com by filling out a data collection form where VINILARTKIDS will receive the necessary information for contracting; this data must be truthful, accurate, and complete about their identity, and the customer must expressly consent by accepting VINILARTKIDS’s privacy policy.

The steps to follow for making a purchase are:

Add to cart.
Choose “continue shopping” or “go to checkout.”
Verify cart.
Proceed to checkout.
Register if not previously registered.
Create an account.
Enter registration details.
Choose address and billing details (if different).
Review details, confirm.
Proceed to checkout.
Choose a shipping method.
Select payment method and confirm order.

Electronically

It is also advisable for the customer to print and/or save a durable copy of the sales conditions when placing their order, as well as the receipt sent by VINILARTKIDS via email.

INVOICE

Together with your order, you will receive the corresponding invoice.

For this purpose, the customer consents to the invoice being sent to him in electronic format. The customer will receive it via email. The customer may, at any time, revoke this consent to receive the invoice in paper form. This invoice will be included in the package.

9. PRICES, EXPENSES, AND TAXES

The prices of the products listed on www.vinilartkids.com will be expressed in Euros unless otherwise stated and will be guaranteed for the duration of their validity, except in case of printing errors and regardless of the destination of the order.

PRODUCTS

Final prices of all products (and if applicable, final prices per unit of measurement, when required), along with their characteristics, offers, discounts, etc., are reflected in each of the items listed in the catalog of www.vinilartkids.com.

VAT is included in the price of the products.
Prices include VAT at 21%.
Shipping costs are not included.

Product prices may vary at any time. In this case, the price to apply will be the one valid on the date of the order. In any case, the final cost will be communicated to the customer during the electronic purchase process before confirming acceptance.

PAYMENT METHODS

We offer the following payment methods:

Stripe

Payment can be made immediately through the Stripe payment gateway. If a return or cancellation of the order is necessary, the amount will be refunded to the same payment card. Personal and banking data will be protected with all security measures established by the General Data Protection Regulation (GDPR) with complete confidentiality.

PayPal

Payment will be authorized through PayPal, but no money will be withdrawn until PayPal verifies its correctness. A PayPal account is required for this.

10. RETURN AND WITHDRAWAL POLICY

According to the regulations, the consumer has the right to WITHDRAW from the contract within a maximum period of 14 calendar days without the need to provide a reason and without incurring any costs, except those provided for in articles 107.2 and 108 of RD1/2007, of November 16, which approves the text referred to in the General Law for the Defense of Consumers and Users.

This right of withdrawal does not apply, among others, to:

Contracts for the supply of products made according to the specifications of the consumer or clearly personalized, or that by their nature cannot be returned or may deteriorate or expire quickly.

PRODUCTS

The customer will have a maximum period of 14 calendar days from the day of receipt of the requested good or product to inform VINILARTKIDS of their desire to withdraw from the contract.

Withdrawal means that VINILARTKIDS will refund the amount already paid by the customer within a maximum period of 14 calendar days, using the same procedure chosen by the customer for payment (provided that the purchased product is not within the previously indicated exceptions).

During this period, the consumer will communicate to the company their decision to withdraw from the contract by filling out the form found at the end of this document and sending it to VINILARTKIDS’s email address. VINILARTKIDS will confirm receipt of the withdrawal in a durable medium.

To return a product, it is essential that it is in perfect condition, with its original packaging, all accessories, and unused.

Once we receive your request, we will contact the customer to provide the details of the return.

The customer will bear the costs of returning the goods.

OBSERVATIONS:

Returned products must be properly sealed and in original packaging without any signs of damage.

11. RESPONSIBILITY AND DISCLAIMER

The consumer has the right to repair, replacement, price reduction, or contract resolution, as established in Chapter II Title IV Book II of the General Law for the Defense of Consumers and Users.

If the product does not comply with the contract, the consumer may choose between repair or replacement of the product, both free of charge, which will be carried out within a reasonable period depending on the nature of the products and their intended purpose.

If, after repair and delivery, the product remains non-compliant with the contract, the consumer may demand replacement, price reduction, or contract resolution.

ADDITIONAL INFORMATION:

The company is not responsible for receiving damaged packages if no record was made on the delivery note.
